Wife of Fatal Crash Victim Files Lawsuits Against Richmond County Sheriff’s Office

AUGUSTA, Ga. – The wife of a man killed in a 2023 crash involving a Richmond County deputy has filed two lawsuits against the former and current Richmond County sheriff as well as Augusta-Richmond County.

The crash occurred on March 26, 2023, when Richmond County Sheriff’s Deputy Ty Dailey, driving a Sheriff’s Office vehicle, collided with Jay and Donna Fager at the intersection of Highway 25 and Cohen Road. According to Georgia State Patrol warrants, Dailey was speeding at 90 mph in a 55 mph zone—35 mph over the speed limit—when the collision occurred, resulting in the death of Jay Fager. Donna Fager was reportedly injured but survived the crash.

In the wake of the tragic incident, the Fager family has sought legal action. The lawsuits, filed by Jay Fager’s wife, allege negligence and misconduct on the part of the Richmond County Sheriff’s Office and its leadership. The suit targets both the current and former sheriff, as well as Augusta-Richmond County.

In May 2024, Deputy Dailey was arrested and booked into the Burke County Detention Center, where he faced charges of homicide by vehicle in the second degree and driving in excess of the posted speed limit, as confirmed by the Burke County Sheriff’s Office.

The case has garnered attention due to the high-speed nature of the crash and the involvement of a law enforcement officer. Legal experts say the outcome of the lawsuit could have significant implications for accountability within law enforcement agencies, especially regarding officers involved in traffic-related incidents.

As the lawsuits move forward, the Fager family seeks justice for the loss of Jay Fager, while the community watches closely as the case unfolds.
